Kenya is a country where no such legal Surrogacy Law in Kenya is applicable because the government of this country understands that surrogacy is a simple procedure which is helping many childless couples who are unable to conceive naturally or women are unable to carry the pregnancy in their own womb due to some medical illness. The surrogacy is a procedure which is designed to complete the life of the childless couples and it is a very simple procedure where the fertility expert will collect the eggs from women ovaries and fertilized them with the sperm of her husband to facilitate fertilization using the procedure called IVF and once the fertilization occurs the resulted embryo will be placed into the uterus of surrogate mother.
The only Surrogacy Policy in Kenya is that both the parties need to sign a mutual agreement to run the procedure smoothly so that no one blames each other at the end of the procedure. This Surrogacy Policy in Kenya states that the surrogate will carry the baby for intended parents in her womb for 9 months and will hand over the baby after the baby birth. On the other side, the intended parents are agreed to sign the Surrogacy Policy in Kenya where it written that they will bear all the expenses of surrogate mother such as travel, food, accommodation, clothing etc. and also pay her for her services in the monthly instalments and the balance left will be paid to the surrogates once the heartbeat of the infant in confirmed through ultrasound.
Also, it is a responsibility of the intended parents that they fulfill the Surrogacy Legalities in Kenya which is that the intended parents need to file Surrogacy Legalities in Kenya on the third day of the baby born with the Court requesting the affirmation of parental status. This is the Surrogacy Legalities in Kenya during which the Court examines the Agreement that has been signed by both the parties and accordingly they will order the Department of Vital Statistics to issue a new birth certificate in the name of intended parents as a legal parent of baby born and surrogate mother has no relationship with the baby born. Both the parties also adhere the Surrogacy Policy in Kenya which says that the surrogate will never meet the baby born in near future and also the intended parents will take care of it.
