Malman Law Wins Record-Setting Award In Illinois Nursing Home Negligence Case

Chicago nursing home negligence attorneys secure over one million dollars for the victim of a preventable hip fracture
 
Chicago, Illinois – The legal team at Steven J. Malman & Associates, P.C., won an Illinois nursing home negligence verdict for a woman who broke her hip at a Hoffman Estates short-term rehabilitation center due to poor care. The $1,011,864.50 award represents the highest award or settlement paid to a nursing home negligence victim involving a similar injury under similar circumstances. This award surpasses the prior highest similar Cook County jury verdict by more than $169,000.

During the Cook County jury trial, Malman Law attorneys presented evidence that a female patient at Alden Poplar Creek Rehabilitation and Health Care over 60 years of age suffered a broken hip while under the care of the center that could have and should have been prevented. Specifically, the attorneys proved that the facility owed a duty of care to the resident, that they did not uphold that duty of care, and that the resident was injured as a result of that breach of duty.

Members of the legal team who assisted with the case included Robert Montgomery, Kelly Sabo Gaden, David Resis, and Kristen Koeller.

“We are incredibly thankful that we were able to secure justice for our client and hold the nursing home in question responsible for their negligent actions,” said Montgomery. “We did not hesitate to take this case to court when we could not reach a settlement because we knew that the jury would understand the case and make the right decision under the law.”

Alden Poplar Creek Rehabilitation and Health Care, Inc., provides transitional care and short-term rehabilitation to those in the northwestern suburbs of Chicago. The for-profit 217-bed facility currently has a 2/5 star rating according to U.S. News & World Report. In the past, the nursing home has received complaints involving issues with bedsore care plans, issues with unnecessary restraints, and issues with catheters and urinary tract infections.

The injured nursing home resident in this case received compensation for past and future medical bills and for the pain and suffering involved with her hip fracture and recovery.
