As such, family law attorneys recognize that there are a few key things clients can do in order for a smoother uncontested divorce process.
A. Don’t point fingers: We know, it is easier said than done. However, your relationship is at this point for a reason and it usually “takes two to tango.” It may indeed be their fault though, however, human nature regrets taking responsibility at times and finger pointing will mostly infuriate, rather than allowing each other to accept the divorce and move on.
B. Leave Behind Your Old Self: Divorce can be an exciting time to renew your personality, change bad habits, and develop who you want to be. Often times, couples who stay together lose self-identity; became angry at each other for unknown reasons. But, divorce allows you to be different to yourself and different to each other. Embrace that, “take the high road,” and have true peace.
C. Children Come FIRST: The law utilizes a “Best Interest” approach when dealing with children. It mandates that when courts consider what will happen to children in divorce that every decision made is made with thinking of the child. How will it affect the child? Will it affect the child? How can the child be shielded from negative affects of divorce? How can positive experiences be developed for the child despite the divorce? If you and your ex can brand this into your mind, your amiability is well on its way.
D. Keep Written Record: It can be exhausting but, the last thing you want are assumptions or misunderstandings to be argued about. When you interact with your soon to be ex-during the divorce process, keep a positive and negative journal to share with your attorney in order to help him/her better serve you and negotiate for you to success. E. Don’t Rush the Newness: Even if you have been looking forward to not being tied to that person any longer, this will indeed be an emotional change-if not now-it will be later. Do not infuriate an emotion in your ex while going through divorce with a new beau or bell. Also, do not expect your ex to embrace the new divorce life and think they will be friendly always because they were before. Be patient with yourself and your ex.
Lastly remember that amicability is friendliness and does not always mean agreeable. If you keep a spirit of friendliness throughout, then your attorney will better be able to assist you in/toward an uncontested divorce.
