Australia, 13 January 2023: The Australian Information Commissioner Act 2010, the Australian Communications and Media Authority Act 2005, and the Privacy Act have all undergone amendments as a result of the Amendment Act. As a result of how they collect and hold personal information, global companies that have operations in Australia could find themselves falling outside the scope of the Data Privacy Act in its current form. It is consistent with changes made to the maximum penalties under the Australian Consumer Law that increasing the maximum civil penalty for serious or repeated interference with Australia Privacy Act will be imposed under the amendment act. Under the amended privacy act, the OAIC will have the power to make declarations upon completion of the private investigation. Also, the amendment act provides the office with the power to address non-compliance with the privacy act by issuing an infringement notice.
