Lucknow, July 30, 2021: On a PIL filed by Ajay Kumar Sharma against UP State Medical Faculty, Allahabad High Court had on 23.07.2021 restrained the Medical Faculty to grant diploma or degree and also from giving recognition to any institution.
The petitioner in his PIL stated that UP State Medical Faculty was established under the Indian Medical Degrees Act, 1916 and the same has been repealed by the government by passing Repealing and Amending Act, 2016.
The petitioner challenged the authority of UP State Medical Faculty to grant recognition to institutes for paramedical and nursing courses after the repeal of the Act giving the Faculty its powers.
As the Medical Faculty could not produce any document on the basis of which they could operate even after repeal of the Indian Medical Degrees Act, the Lucknow Bench of Allahabad High Court had stayed its operations in entirety.

Respondent no. 3 was created under the Indian Medical Degrees Act, 1916. The said Act has been repealed by the repealing and amending Act of 2016, thus, respondent no.3 would be restrained to grant a diploma or degree and even to recognize any institution, till the next date of hearing.
