Today's world is forever changing along with the laws from yesterday.  Laws that seemed okay back when, but do not really fit with the times of today.  Marijuana and the legalization has been a popular topic in the news today.  On 16th of September, the bill has been introduced to fight against Drug Enforcement Administration (DEA) and their often unlawful “confiscation” of the property for marijuana business owners .

States are legalizing for medical and/or recreational use of Marijuana while the Federal Government still takes a stand on Marijuana as illegal and that is the government's final word.  With legalization on the State level and not the Federal level there will be some issues to arise and most are wondering what the Federal government can do to anyone taking part in owning any Marijuana dispensaries and how can they be fought.

Civil forfeiture is what the government plans on using.  Civil forfeiture is a legal tool that allows law enforcement officials to seize property that they assert has been involved in certain criminal activity without the owner even being convicted.   A family member could be the one doing the illegal activity without the owner's knowledge but the government can still punish the owner.

With so much information and so many loop holes the law on civil forfeiture in different states could be confusing and a bit hard to follow how it is truly legal.  With states legalizing Marijuana, states such as Alaska, Colorado, Oregon and Washington, there seems to be a decline in the cases being brought up.  Although that yes there is a decline that doesn’t mean the government has decided to turn their attention to something else.  This following article will go over past cases and people that the Federal government has gone after for their property.  The details for different states will be shown and how one might stand a fighting chance to keep property that is so rightfully theirs.

With the laws transforming as the world moves forward, people, business, and products just to name a few, It is wise to stay up to date on all the information with Civil Forfeiture.   One could only hope that one day the two levels of law can come together to decide on one common law so that the rights of the American citizen would not be in jeopardy.  Until then, let's hope that you find the answers you are looking for here.
