Nan Inc Owner Prevails In Rail-Related Whistleblower Lawsuit

Nan Inc is the largest locally-owned general contractor located in Honolulu, Hawaii. It has the capacity and expertise to execute the most complex projects in Hawaii. Today, the CEO and owner of Nan Inc, Patrick Nan Shin, has triumphed in a whistleblower lawsuit initiated by the firm's former in-house counsel, Bosko Petricevic.

Bosko Petricevic had alleged he was fired by Nan Inc. after warning the company not to conduct “illegal activity” related to the multibillion-dollar transit project. In 2019, he went ahead and sued his former employer, Nan Inc, alleging in state court that the local construction firm had engaged in multiple illegal practices, not all related to rail.

On Wednesday, July 21, 2021, a jury ruled in favor of Nan Inc owner Patrick Shin. The jury found no evidence that Petricevic had been fired due to his whistleblowing. The jury also rejected Nan’s counterclaim that Petricevic had painted the company’s CEO in a false light, according to the verdict sheet.

“This verdict states that Nan, Inc.’s termination of the plaintiff was proper and legal,” Shin said in a statement Thursday. “This positive outcome confirms all of Nan, Inc.’s hard-working employees and positive reputation in the Hawaiian community for the last 30 years.”

Petricevic declined to comment Friday on the verdict. It’s unclear whether he plans to appeal.
